Causal Link Analysis: An Examination
The Indian authorities have recently recommended discontinuation of anti-dumping duty in respect of two products, finding absence of causal link. The article in this issue of Amicus, while exploring various difficulties in undertaking a causal link analysis, also examines whether such an examination should be taken at the time of sunset review. After considering Article 3.5 of the Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994 and WTO DSB reports, the author is of the view that it is difficult to undertake such an analysis due to lack of guidance in the AD Agreement. Further, it is stated that though according to the DSB Appellate Body report, authorities are not required to undertake a causal link analysis “anew” in an expiry review investigation, India’s practice of undertaking such analysis even in sunset review proceedings is merely an additional step to be satisfied which does not prejudice the rights of parties in any manner.
