Extension of Safeguard duty measures, after they have lapsed, is the topic of discussion this month. Article in this October 2013 issue of International Trade Amicus argues that initiation of review should not be equated with the extension of the said trade remedy measure and that India, in this regard, needs to review its practice of review of safeguard measures in order to be fully compliant with its obligations under the WTO's Agreement on Safeguards. Table under Trade Remedy News covers anti-dumping actions by India and also those taken by other countries against India. In WTO, while Indonesia has joined in consultation with Australia on the latter's tobacco plain packaging provisions, Russian Federation has joined the agreement on trade in information technology products. USA has begun investigation of India's discriminative policies in relation to trade, investment and industry and their effect on the US economy. Further under 'Ratio decidendi', European Court of Justice has upheld the use of different methodologies by the authorities, for calculation of dumping margin, at the time of review.
