Appointment of arbitrators – Procedures cannot be bifurcated

The Supreme Court has held that the procedure followed by the Calcutta High Court in considering applications for appointment of arbitrator(s) under Section 11 of the Arbitration and Conciliation Act, 1996 in a piecemeal manner is legally impermissible.

Trademark – Section 124 applicable to stay infringement suit and not suit for passing-off

Observing that the defendant had never abandoned the plea of invalidity and had filed the rectification proceedings within three months before IPAB, Delhi High Court has stayed the suit for infringement of trademark, under Section 124 of the Trademarks Act, 1999.
Implantable medical devices will now be drugs

The Central Drugs Standard Control Organization (CDSCO) on June 22, 2018 issued a public notice regarding medical devices. Through the notice, the CDSCO has proposed to include implantable medical devices within the purview of Section 3(b)(iv) of the Drugs and Cosmetics Act, 1940 (the Act), and now would be considered as ‘drugs’.
